Planning Board denies Ogunquit Village Estates plan

OGUNQUIT - On Monday night, May 14, the Planning Board voted to deny the preliminary plan for the 34-lot Ogunquit Village Estates subdivision off Berwick Road.

Planning Board Chairman Steve Wilkos said the decision was made to deny the application based on a recommendation from the town's planning consultant.

Wilkos said that recommendation was made after the applicant met with the Board of Selectmen on April 17 to go over his plans for traffic mitigation at the intersection of Route 1 and Berwick Road, which he was required to do before coming to the Planning Board for preliminary approval.

"The applicant, Stephen Hallett, had eight traffic mitigation proposals," said Wilkos, "and he went before the Board of Selectmen, and they rejected each one of the proposals."

The decision by the Planning Board comes almost five years after the developer first filed for the subdivision approval in September of 2002 to build a retirement community for senior citizens.

The Planning Board approved the development on March 14, 2005, but its decision was reversed by the Maine Supreme Court back on Nov. 7, 2006, when the court agreed with abutter William Boduck that the board had erred in its interpretation of the traffic standards ordinance.
